Kugler Wechsler announces a landmark decision rendered by the Court of Appeal on September 18 in Beaudoin v. Jarcevic.
In reasons written by the Honourable Benoit Moore, the Court of Appeal dismissed nearly all of the appellant physician’s arguments and confirmed an award that, as of the date of the judgment, totals nearly $28 million in capital and interest for the victim’s family.
“This decision is an important step forward for victims of medical malpractice and serious personal injury,” said Alexandre Brosseau-Wery, who argued the appeal. “The Court of Appeal affirms key legal principles that are essential to full compensation for victims. We are very pleased with this outcome, which will help our clients live with dignity and approach their child’s future with greater security.”
